The holder of all rights on the www.mehrzer.com website is the Teroma trgovina d.o.o. trading company.

Teroma trgovina d.o.o. through the mentioned website, provides sales service through its service – Mehrzer web store. By using the service of the Mehrzer web store and all associated pages and services on the www.mehrzer.com domain, it is considered that customers are at all times familiar with these Terms of Business (hereinafter: Terms) and that they fully understand and accept them. 

These Terms apply to the rights and obligations related to the purchase of products or services through the Mehrzer web store, as well as to the rights and obligations arising from the conclusion of the Distance Selling Contract (hereinafter: the Contract) between the customer as the end customer and Mehrzer web store, and are considered an integral part of such contracts. We advise customers to familiarize themselves with these Terms and Conditions before making a purchase and to check them regularly, in order to be aware of all their rights and obligations. Teroma trgovina d.o.o. reserves the right to change these Terms of Business at any time without the obligation of prior notice and shall not be responsible for any consequences that may arise from such changes. The above-mentioned changes will come into force upon publication on these Internet pages.

Teroma trgovina d.o.o. reserves the right to terminate the service and change the contents as well as other services and sub-pages that are an integral part of the Mehrzer web store at any time without prior notice and will not be responsible for any consequences that may arise from such changes. 

Teroma trgovina d.o.o. reserves the right to change, limit or stop providing the Mehrzer web store service at any time without prior notice, in addition to partially or completely restricting access as well as providing certain services to users who violate the provisions of these Terms and the Privacy Statement. The Mehrzer web store fully disclaims any responsibility for the accuracy and/or completeness of all information and content found on www.mehrzer.com. Mehrzer web store reserves the right to make an error in the product description or image. Product images on the Mehrzer webshop are illustrative only. The image illustrating the product on the website www.mehrzer.com may not fully correspond to the actual appearance and content of the product and the customer cannot submit a complaint for such products on this basis.

Mehrzer will endeavor to publish accurate and up-to-date information on the www.mehrzer.com website, but does not assume responsibility for their accuracy and completeness.

3. INFORMATION AVAILABILITY


The Mehrzer web store undertakes to provide the following information to the customer, before he is bound by the contract or offer: information about the company Teroma trgovina d.o.o. (name and headquarters of the company, OIB), contact information that allows the user to communicate quickly and efficiently (contact email, telephone), essential characteristics of the article, availability of the article (each article offered on the website should be available within a reasonable time) , terms of delivery of the article, prices that must be clearly and unambiguously determined and it must be clearly shown whether the prices already include taxes and transport costs, the deadline in which it is possible to withdraw from the contract and the conditions for withdrawal and explanation of the appeal procedure.

4. ORDER


The sales contract between the Mehrzer web store and the customer in the web store is concluded at the moment when the Mehrzer web store sends the customer the first email about the status of his order (order receipt confirmation). From that moment on, all prices and other conditions are fixed and valid for both the Mehrzer web store and the customer. The customer is the person with the data specified when submitting the order. It is not possible to change customer data later.

5. TERMS AND PROCEDURE OF PURCHASE


The main characteristics of the product, the method of its use, prices, special promotions and benefits, methods of payment and delivery refer to those that are valid at the time of concluding the order. The above data will be indicated with each product. The price of the product, including the amount of VAT and the cost of delivery, is visible in the shopping cart before the order is placed. The shipping cost may also be visible on some other parts of the website. 

All information about the purchase confirmation based on the electronic order will be delivered to the customer’s email address specified in the registration/order process or in the shopping cart when entering data to conclude the order. If the customer does not receive a notification about the confirmation of his order, there is a possibility that he entered the wrong email address. In that case, we ask the customer to contact us at: mail@mehrzer.com so that our customer service can check whether the order has been received. 

When ordering through the Mehrzer Web Store, you agree not to create false or misleading orders. The use of a false identity or a misleading order is considered an attempt to defraud, and we reserve the right to report it to the appropriate authorities for abuse.

6. PAYMENT METHOD AND PROCEDURE


All prices are in EUR and include VAT (25%). The product price does not include delivery costs, which are added to the total price of the product or service.

Prices may change at any time. However, price changes will not affect orders for which we have sent a confirmation of receipt.

After you have selected all the items you want to buy, they will be added to your cart. The next step is to process your order and pay. For this purpose, it is necessary to follow the steps of the purchase procedure and specify or confirm the required data at each step. In addition, you can change your order information during the purchase process before paying. Also, if you are a registered user, you can access the history of all your orders in the section “My user account”.

Payment of the product price and shipping costs can be made in one of the following ways:

a) Payment by credit or debit card. Ordered products can be paid online with one of these credit cards: Visa Premium, MasterCard, Discover, Diners, Visa, Maestro, MBNet Maestro plus, Visa inspire,Union Pbz International.

b) Payment by general payment slip. The products for which the order has been concluded can be paid by means of a general payment slip in all branches of banks, FINA or at the counters of Croatian Post. After confirming the order, the Mehrzer store forwards by e-mail the data required for payment by general payment slip. All data must be entered correctly in the general payment slip and the payment must be made within the deadline.

c) Payment by Internet banking. The products for which the order has been concluded can be paid for via Internet banking of any bank where the possibility of such a payment method is open. After confirming the order, the Mehrzer store forwards by e-mail all the necessary data for making the payment.

d) Discounts are available for all forms of payment for products on sale.

7. DISCOUNT CODE


The discount code brings various advantages when purchasing through the Mehrzer web store and is limited in time. You can find the active discount code on the front page, on the page of an individual section in our newsletter, or in other media.

In the event that the customer uses the discount code, and subsequently cancels the order with the discount code at his own will, the discount code will be considered used.

Using a discount code: Select the items you want to purchase and add them to your cart. When you have finished adding items to your cart, click the Proceed to Checkout button. Choose the delivery method, specify the delivery address and choose the payment method.

In the same step, there is a field for the discount code, enter the code in this field and confirm by clicking the Confirm button. The discount code is a one-time use code, which means you can only use it once.

8. PURCHASE NOTIFICATION PROCEDURE


8.1. Order to purchase an item in the Merhzer web store 

After placing his order, the customer receives a notification via email that the order has been received. The Mehrzer web store reviews the orders, checks the availability of the ordered items and confirms or rejects the order with a reason. The Mehrzer web store can call the customer on his contact phone number in order to check the data or ensure the accuracy of the delivery. The delivery of items that the Mehrzer web store does not have in stock in its warehouse depends solely on the supplier and the deadline in which the supplier can deliver the items to the Mehrzer web store. 

The Mehzer web store does not assume any responsibility for damage caused by a longer delivery period or due to non-delivery of items that the Mehzer web store does not have in stock in its warehouse.

8.2. Order shipped/prepared for pickup

The Mehrzer web store prepares and sends the item for delivery, and informs the customer by email about the policy of withdrawing from the contract, to whom he should contact in case of delivery delay as well as in case of complaint.

In case the customer decides to cancel the order in a timely manner, he must immediately notify the Mehrzer web store by sending an email to the address mail@mehrzer.com.

9. PURCHASE FOR LEGAL PERSONS


The purchase procedure for legal persons is the same as for natural persons, only in the first case you should select an VAT account for the company and confirm your agreement with the Terms of Business. 

If you want an VAT account, you accept the Terms of Business that apply to legal persons. The main difference is the possibility of withdrawing from the contract: we allow companies, entrepreneurs and other legal persons to return purchased items within the warranty conditions. The aforementioned legal persons do not have the possibility to withdraw from the contract within 14 days from the day of taking over the item without reason, as is the case for buyers who are natural persons. Refunds are not possible for legal persons.

The Mehrzer web store’s Terms of Business apply to legal persons as customers. The rules on consumer protection prescribed by the Law on Consumer Protection do not apply to legal persons.

10. BUYER’S RIGHT TO WITHDRAW THE CONTRACT


10.1. Contract conclusion  

These Terms, as well as the individual terms of sale listed with the information on certain products, represent the offer of the Teroma trgovina d.o.o. company for the conclusion of the Contract, so that the buyer, by accepting the offer, concluding the order or in another way determined by these Terms, accepts the same, which is considered to have concluded the Contract between the buyer and the Teroma trgovina d.o.o. company, in accordance with the terms of sale specified in these Terms.


The subject and commercial purpose of the Contract is the purchase of the selected product or service through the Mehrzer web store with the payment of the appropriate fee – the price of that product or service. The Contract is concluded through remote communication (Contract concluded at a distance) through: printed promotional messages with purchase order, by telephone with and without human mediation and via the Internet.
The Contract enters into force and is binding from the moment the customer accepts the offer of the Teroma trgovina d.o.o. company in one of the following ways:

10.2. Legal right to terminate the Contract

The customer (applies only to natural persons who purchase items for purposes out of their business) has the right to notify the Mehrzer web store within 14 days of receiving the item that he is withdrawing from the Contract, without having to state the reasons for his decision. The deadline for withdrawing from the Contract begins on the third day after the day of collection of the item.

The buyer informs the Merher web store about the withdrawal from the Contract by sending an email to the address mail@mehrzer.com with an attached form for withdrawing from the Contract on the purchase of the item, which the buyer can find here:

The return of the received items to the seller within the Contract withdrawal period is understood by sending a contract withdrawal notice. This means that the item must be returned to the seller no later than 30 days from the date of sending the notice of withdrawal from the Contract (purchase).

The buyer must return the item undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has been reduced through no fault of the buyer. The buyer may not use the item indefinitely from the moment of withdrawal from the Contract. The buyer may inspect the item and try it on to the extent necessary to determine the actual condition of the item. Testing of the article that does not comply with the above is considered as using the article, which means that the buyer thereby loses the right to withdraw from the Contract.

The only cost incurred by the buyer if he cancels the contract is the cost of returning the item.

The customer does not have the right to terminate the Contract in the cases prescribed by Art. 79 of the Law on Consumer Protection, i.e.in the following cases;
-the seller has completely fulfilled the service Contract, and the fulfillment began with the prior express consent of the consumer and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Contract from this section if the service is completely fulfilled.

-the subject of the Contract is easily perishable goods or goods with a fast expiration date.

-the subject of the Contract is sealed goods which, for health or hygiene reasons, are not suitable for return, if they were unsealed after delivery.

-the subject of the Contract is the delivery of a sealed audio or video recording, i.e. a computer program, which are unsealed after delivery.

-the subject of the Contract is the delivery of digital content that was not delivered on a physical medium, if the fulfillment of the Contract began with the prior express consent of the consumer and with his confirmation that he is aware of the fact that he will thereby lose the right to unilaterally terminate the Contract

In case of cancellation of a purchase in which a bonus, discount code or promotional code was used, these funds are considered a discount and are not returned to the user. Only the paid amount is refunded. In case of withdrawal from the Contract, the gift voucher is considered a means of payment and is returned to the user as a gift voucher, and the amount paid is returned to the user.

11. WARRANTY


All Mehrzer products have a 12-month warranty, while stainless steel cookware has a 100-year warranty.

The warranty is only valid if the instructions given on the warranty card are followed and the invoice is submitted.

12. MATERIAL DEFECTS


A material defect can be recognized in the following situations:

-the item does not have the characteristics necessary for its normal use or circulation,

-the item does not have the characteristics required for the special use for which the customer is buying it, which are known to the Mehrzer web store, or should be known to it,

-the item does not have characteristics or properties that are expressly or tacitly agreed upon or prescribed,

-the Mehrzer webshop has supplied an item that does not conform to the sample or model, unless the sample or model is shown for informational purposes only.

The suitability of the item is checked using another perfect item of the same type, simultaneously with the manufacturer’s statements, i.e. the statements on the item itself.

How is the material defect recognized?

The customer must notify us of any material defect with a detailed description of it within the legal deadline and at the same time allow us to inspect the item.

12.1. Collection of items returned after warranty processing or due to material defect

After processing, the customer is obliged to collect the item that Mehrzer web store has given for warranty processing or other processing. The customer collects the item at a previously agreed upon location, and in case the item was sent by mail, it will be returned to the delivery address.

The Mehrzer web store sends a notification to the customer about the return of the item from processing and invites him to collect the item. The customer is obliged to collect the item within 14 days from the day of receipt of the notification.

If the customer does not collect the item within the specified period, the item is handed over to the seller for safekeeping at the address of his warehouse:

The Mehrzer web store stores the item in its warehouse until the expiration of 6 months from the date of notification. Merhzer webshop is entitled to a refund of all storage costs during this period, as well as the right to a refund of all item storage costs.

13. MEHRZER WEB STORE COMMUNICATION WITH USERS


By registering and purchasing our products and services, you agree that the Mehrzer web store, in order to promote its services and products, can notify you via e-mail about changed or added content on its pages, about discounts, promotions, products or changes in the way services are provided. The user can withdraw his consent at any time.

14. DELIVERY


UPS, OVERSEAS, DHL are the contractual partner of the Mehrzer web store for the delivery of parcels. Delivery is made exclusively on the territory of the EU.

17. DISCLAIMER OF LIABILITY


The Mehrzer web store makes every effort to ensure that the information published on its web pages is up-to-date and accurate. Despite this, the characteristics of the items, the delivery time and the price can change so quickly that the Mehrzer webshop fails to correct the information on its web pages. In this case, the Mehzer web store will inform the customer about the changes and enable him to withdraw from the Contract or replace the ordered item.

The Mehrzer web store is not responsible for the content related to the opinions of the website visitors about the articles. Mehrzer web store, before publishing them, reviews and rejects opinions that contain obvious falsehoods, which are inappropriate, misleading or offensive. Mehrzer webshop is not responsible for the information in said opinions and disclaims any liability that may arise from the information stated in said opinions.

The Mehrzer web store has the option of withdrawing from the contract only if an obvious error is established (The Law on Obligatory Relations of the Republic of Croatia). An obvious error is considered to be an error in the essential characteristics of the item or service, as well as all misconceptions that are considered decisive according to the store’s practice or the customer’s intention, and which the Mehrzer web store, if it had knowledge of them, would not have confirmed, i.e. would not have concluded contract. This includes obvious pricing errors.

18. GENERAL RULES AND TERMS OF USE


18.1. Use of Merhzer Internet service pages

It is prohibited to use the web pages and their content for any purpose that is not related to doing business with the Mehrzer web store and that is in any way inconsistent with these Terms.

The customer acknowledges and warrants that he will use this website in accordance with these Terms and all applicable laws and regulations, including without limitation all those relating to the Internet, e-mail (electronic mail messages), data and privacy.

The customer confirms and guarantees that he will use the downloaded content exclusively in a manner that is in accordance with these Terms, otherwise such use is considered illegal, and in such a case Teroma trgovina d.o.o. is authorized to demand compensation from the customer and to limit the provision of the service in whole or in part.

18.2. Registration – User account

Registration or user account is created only for one natural or legal person. By registering for the services of the Mehrzer web store, the customer receives information about his user account – username and password. The user account cannot be transferred to other persons. The user account of legal person can only be used by the responsible person specified as such during registration.

It is strictly prohibited to use other people’s data, as well as false representation in the name of another legal or natural person.

Disclosure of registration or user account data to third parties is strictly prohibited.

The use of someone else’s registration or user account is strictly prohibited.

It is strictly prohibited to use the Mehrzer web store, in any way, for sending or encouraging the spread of unwanted electronic communications (so-called spamming).

In case of violation of the provisions of the Terms from this chapter, the Teroma trgovina d.o.o. company reserves the right, at its sole discretion, to deny registration or terminate the customer’s account, without obligation to compensate the customer for any costs or damages.

18.3. Obligations of registered customers

In the process of registering or creating a user account, the customer has the obligation to choose the name or names under which he will receive services, a security password and to provide a valid email address and all necessary data. All data required to register or create a user account must be complete and true. By completing the registration, the customer accepts these Terms and responsibilities for all activities caused by the use of the content and services of the Mehrzer web store.

The customer has the obligation to keep data about his security password and his user account, and is fully responsible for all damages caused by unauthorized use of his user account.

18.4. Obligations of unregistered customers 

If the customer uses the Mehrzer web store as an unregistered customer-guest, he undertakes that all the data for the conclusion of the Purchase Contract are true and accepts all the above-mentioned Terms.

18.5. Internet service content, software, services and applications 

All content displayed or found in/on the Mehrzer web store, including but not limited to published text, graphics, illustrations, photographs, audiovisual works, sound, documents, data and information, may not be reproduced, distributed or used in any manner inconsistent with these Terms.

In particular, it is strictly prohibited to change, publish, transfer, sell, display, modify, copy or in any other way exploit the content, visual identity, applications and software of the Mehrzer web store, except when such possibility is provided for in these Terms or is the result of prior approval from the Teroma trgovina d.o.o. company.

It is prohibited to use the services of the Mehrzer web store for commercial purposes in any way, as well as in a way that is contrary to these Terms. It is strictly prohibited to copy and save the content for any purpose and in any way, as well as in a way that is contrary to these Terms.

In case of unauthorized, prohibited and/or illegal use of any content (text, photos, applications, software, audiovisual works) of Mehrzer web stores, the Teroma trgovina d.o.o. company reserves the right to demand compensation for all damages and to initiate civil and criminal proceedings before the competent courts against the legal and/or natural person who uses the Mehrzer web store in the manner described.

The use of the services of the Mehrzer web store is approved for adults. The use of the Mehrzer web store for children is allowed only under the supervision of parents/guardians who are obliged to take care of it, otherwise they assume all rights and obligations arising from such use, and the Teroma trgovina d.o.o. is not responsible for the possible consequences of such use of Mehrzer web store services.

19. COMPLAINTS AND DISPUTES


The Mehrzer web store complies with the current Consumer Protection Act. The complaint is submitted to the email address mail@mehrzer.com. The complaint handling procedure is confidential.

Mehrzer web store is aware of one important feature of consumer disputes – the disproportion between the economic value of the claim and the time and costs required to resolve the dispute, which is the main obstacle for consumers to start a dispute before the court. That’s why the Mehrzer web store tries, as far as it can, to resolve disputes amicably.

We hereby inform you of our good will to resolve any dispute peacefully and amicably, as well as of your right to use the mechanisms of out-of-court settlement of consumer disputes based on the right to initiate the out-of-court dispute settlement procedure by submitting an application to the Court of Honor of the Croatian Chamber of Commerce, and/or by submitting a proposal for conciliation to the Center for Conciliation at the Croatian Chamber of Commerce.
